In Doe v. Iowa District Court for Polk County (Nov. 2025), the Iowa Supreme Court clarified that § 901C.3 requires whole-file expungement—meaning when a conviction is expunged, the entire case file is sealed, including any dismissed counts.

Common Questions

Can I really only expunge one misdemeanor conviction ever? +
Yes. Iowa Code § 901C.3 explicitly states this is a "once-in-a-lifetime" opportunity. Even if you get convicted of another eligible misdemeanor 20 years from now, if you've already used § 901C.3, you cannot use it again. This makes choosing which conviction to expunge (if you have multiple) critically important.
I have multiple misdemeanor convictions. Which should I expunge? +
This requires strategic legal analysis. Generally, you'd expunge the conviction that's causing the most problems (showing up on background checks, preventing employment, etc.) or the most serious charge. We recommend a consultation before filing if you have multiple convictions, as this decision cannot be undone.
What does "in the interests of justice" mean? +
The court has discretion to deny expungement even if you meet all technical requirements if it's not "in the interests of justice." Factors include: how long ago the conviction occurred, your behavior since then, rehabilitation efforts, employment/education goals, and whether expungement serves the public good. Our attorney will prepare a detailed brief addressing these factors.
Can I expunge my OWI/DUI? +
No. Iowa Code § 901C.3 explicitly excludes Operating While Intoxicated (OWI) from expungement. This exclusion applies to all OWI offenses regardless of when they occurred or how long ago. OWI convictions cannot be expunged in Iowa under current law.
What if I have a deferred judgment that was already expunged? +
You may still be eligible for § 901C.3 expungement of a different misdemeanor conviction, but there's a limit: you cannot have been granted two or more deferred judgments in your lifetime. One prior deferred judgment does not disqualify you from using § 901C.3.
